Acceptance of Terms
The services that Off-Site Computing provides you are subject to the following Terms of Use ("TOU"). Off-Site Computing reserves the right to update the TOU at any time without notice. The most current version of the TOU can be reviewed by clicking on the "Terms of Use" hypertext link located at bottom of each web page.
Non-Commercial Use Limitation
Unless otherwise covered by a work agreement, you may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from Off-Site Computing.
Software Available on this Web Site
Use of software is governed by the terms of end user license agreements, if any, which accompanies or is included with the software license agreement. An end user will be unable to install any software that is accompanied by or includes a license agreement, unless the individual first agrees to the license agreement terms.
Software is made available for download solely for use by end users according to the license agreement. Any reproduction or redistribution of software not in accordance with the license agreement is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.
Software is warranted, if at all, only according to the terms of the license agreement. Except as warranted in the license agreement, Off-Site Computing hereby disclaims all warranties and conditions with regard to the software, including all warranties and conditions of merchantability, whether expressed or implied, fitness for a particular purpose, title and non-infringement.
Restricted Rights Legend. Any software which is downloaded from Off-Site Computing for or on behalf of the United States of America, its agencies and/or instrumentalities ("U.S. Government"), is provided with Restricted Rights. Use, duplication, or disclosure by the U.S. Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the Commercial Computer Software - Restricted Rights at 48 CFR 52.227-19, as applicable.
Software and Services Available on this Web Site
In no event shall Off-Site Computing be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, data or profits, whether in an action of contract, negligence or other action, arising out of or in connection with the use or performance of software, documents, provision of or failure to provide services, or information available from services.
Member Account, Password, and Security
If any service requires you to establish a site account, you must complete the registration process by providing current, complete and accurate information as prompted by the applicable registration form. You also will choose a password and a user name. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify Off-Site Computing immediately of any unauthorized use of your account or any other breach of security. Off-Site Computing will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by Off-Site Computing or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder.
Prohibited Use
As a condition of your use of services, you will not use services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use services in any manner that could damage, disable, overburden, or impair any Off-Site Computing server, or the network(s) connected to any Off-Site Computing server, or interfere with any other party's use and enjoyment of any service. You may not attempt to gain unauthorized access to any service, other accounts, computer systems or networks connected to any Off-Site Computing server or to any of service, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through services.
Communication Services
You agree to use communication services only to post, send and receive messages and material that are proper. Off-Site Computing has no obligation to monitor the communication services. However, Off-Site Computing reserves the right to review materials posted to communication services and to remove any materials at its sole discretion. Off-Site Computing reserves the right to terminate your access to any or all communication services at any time, without notice, for any reason whatsoever.
Always use caution when giving out any personally identifiable information about yourself in any communication service. Off-Site Computing does not control or endorse the content, messages or information found in any communication service and, therefore, Off-Site Computing specifically disclaims any liability with regard to communication service and any actions resulting from your participation in any communication Service.
Materials uploaded through communication services may be subject to posted limitations on usage, reproduction and/or dissemination; you are responsible for adhering to such limitations if you download the materials.
